Terms and Conditions

T&C: USE OF SITE

You are hereby granted permission to view and access information presented at www.versuitile.com and www.versuitile.com.my including downloads, with the full understanding that everything is presented on an “as-is” basis.

As a condition of your access to and/or use of the Site, you warrant that:-

1. All information supplied by you on the Site is accurate, current and complete;
2. You are 18 years of age or older in order to access and/or use the Site;
3. Where you create a user account and password, you must treat such information as confidential, and you must not disclose it to any third party; 
4. You shall be solely responsible for your access to and/or use of the Site and its materials herein;
5. You agree and undertake not to impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity;
6. You will not copy or distribute any part of the Site in any medium without Versuitile's prior written authorization;
7. You will not infringes any third-party intellectual property or any other proprietary rights or otherwise illegal under any applicable law;
8. Versuitile reserves the right to repost or reuse information referring/communicated to Versuitile via emails, social media channels or contests run by Versuitile; and 
9. In the event of any dispute, Versuitile reserves the right of final decision. We reserve the right to disable any user account at any time, if in our opinion you have failed to comply with any of the provisions of these T&Cs.

T&C: PERSONAL DATA

We may collect, use and disclose personal data that you provide to us to supply the product to you, process your payment for the product, to send you newsletters if you have registered for our mailing list, and other specified purposes. Please see our Privacy Policy for more information.

T&C: IMAGE USE AGREEMENT

As part of the Versuitile-community, we love your image and know many others will definitely be inspired when they see your image on our website, social media channels, advertisements, retail stores and retailers’ websites. As you consent to allowing us to publish your image, we want to make sure you know exactly how we intend to use it.

By providing your permission, you represent and warrant that you own the image and there are no other entities with ownership claims over it. You grant Versuitile Sdn Bhd the non-exclusive and non-revocable commercial right to reproduce the image in any form (including, but not limited to, social media posting, website usage, paid advertising, emails, publication, and distribution), either through our own services or services provided by third parties, throughout the world in any medium now known or later developed and without restriction or limitation.

T&C: THIRD PARTY SITES

The Site may contain links to third party websites that are not affiliated with or owned, operated, or controlled by Versuitile, including third party payment gateway providers. By using the Site, you expressly relieve Versuitile from all liability arising from your access and use of any third party website and that you acknowledge and agree that Versuitile is not responsible for the content, privacy policies, or practices of such third party websites or the companies that own them. 

T&C: ORDERS 

1. You may place an order with us by completing and submitting the order form on the Site.
2. Our customer service are unable to make any amendments after you have confirmed your order.
3. Each fully-paid order accepted by us shall constitute a separate and individual contract governed by these T&Cs (an "Order"). We will assign an order number to your Order when we accept your Order. Please tell us the order number whenever you contact us about your Order.
4. If an order is cancelled, no cash refund is offered. 

T&C: PAYMENTS

1. All payments must be made for the orders to be confirmed. We accept all major credit cards, online bankings and e-Wallet. We do not accept COD.  
2. No cash refund is offered. We only offer refund in terms of store credit.
3. All orders will be automatically cancelled after one (1) hour of non-payment.
4. We reserve the right to amend the price of any product at any time without giving any reason or prior notice. Please complete payment at the moment your order was placed as all unpaid orders will be cancelled automatically after one (1) hours.
5. Prices and shipping rates are subject to change without notice but changes will not affect orders that have already been accepted.

T&C: DELIVERY

1. Versuitile is unable to amend orders nor combine orders which were separately made after it is placed. Please double check your order details before confirming the order.
2. All orders are processed and dispatched within 1 to 2 working days upon verification of payment. Delivery is carried out during working hours, Monday through Friday, excluding weekends and local public holidays(Malaysia).
3. Once the Dispatch Confirmation is emailed to you, your products are under the responsibility of our third party postal service providers and we shall not be responsible for lost parcel in post if proof of postage is supplied. Any claim will have to be made with our third party postal service providers and we will make reasonable effort to assist in compensation claims (if any).
4. For all international orders, any customs or import duties charged once the parcel reaches its destination country (if any) must be paid for by the recipient of the parcel. In the case if tax not paid within the stipulated period , goods will be forfeited and destroyed by customs department which is not under our control.
5. Price of postage includes handling fees.

T&C: BOUNCED PARCELS

1. Customers will be contacted via email should we receive any bounced parcels bearing their name.
2. Cost for re-delivery will be borne by the customer. Versuitile will only bear the cost of re-delivery if it is deemed as an error on our part (product defects). 
3. Versuitile will deny any request to combine the bounced back parcels with any new orders.
4. Any unclaimed bounced back parcels after 30 days grace period will be forfeited.

T&C: RETURN POLICY

Scenario 1

Versuitile provides FREE returns for all items, ONLY if it is deemed as an error on our part (product defects/wrong item(s) sent), but customer needs to record a full unboxing/unwrapping video! The video is necessary as proof for damage cases, so please record it in clear lighting. 

Email us the unboxing/unwrapping video and pictures of the products with your Order ID number to versuitileaftersales@gmail.com with subjects: "Order ID: XXX" no more than 14 DAYS from the receipt date.

Scenario 2

Versuitile allows return/return for exchange (Return cost to be borne by customers) if customers intend to return/return for exchange for the said purposes: change of sizes/color/items.

1. For refund, no monetary refunds will be given for any reason, though alternative refunds may be offered, such as store credit for the next purchase.
2. For exchange, the requested exchange item(s) is/are subject to stock availability. 

Email us with your Order ID number to versuitileaftersales@gmail.com with subjects: "Order ID: XXX" no more than 14 DAYS from the receipt date.

1. Used product cannot be returned or exchanged. We're sorry but we can't accept an exchange if you don't have the video or the video you have is edited/paused.
2. Items must be in its original condition (tag intact, unworn, unwashed and unaltered). Exchanges for articles which do not meet all mentioned conditions will be duly declined. All items are not to be soaked.
3. If color runs due to this reason, item/s is strictly not returnable.
4. The Return department will get back to you once a return item is received by us and we will email your credit voucher once the item is received.
5. If you believe you have received the wrong item, at versuitileaftersales@gmail.com with your order number, and a photograph of the item. We may ask you to proceed with sending your item back to us, for which your postage will be reimbursed. Please note that items must be unworn, unwashed, unaltered, and with its tags intact. If the correct item is no longer in-stock, store credit will be issued instead.
6. All returns which do not meet the above-mentioned criterias will be strictly declined and forfeited.
7. The return parcel is under customers' responsibility and Versuitile is not liable for any any lost return parcel/ additional taxes incurred for return parcels. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods. Please keep the tracking code with you in case we shall need them for reference.
8. All returns are final and further requests will be denied.

*Color of products may varies due to studio lighting used and please allow 20% of color variation in real product as compared to actual products. It may appear darker or lighter. Exchanges due to this reason will not be allowed.

*There might be 1cm-2cm differences in the measurements given due to the different stretchable quality of the material. Please do check the measurements given in our products and compare with your existing dresses for best fit. 

*For printed items, the prints may vary in terms of symmetry/alignment/slight color patches for each piece and return due to this reason is not considered a defect.

T&C: LOYALTY PROGRAMS 

If you participate in the loyalty program, you agree to the following: 

1. Your store credits have no cash value and may not be exchanged for cash. 
2. Your points and rewards cannot be transferred, brought, sold or in any way traded and can only be utilized by the account holder unless otherwise stated. 
3. Points earned and/or redeemed will be updated on your online account within a reasonable period of your transaction. If it is not utilized within the given timeframe, the amount will be forfeited. (unless otherwise stated)
4. Unless otherwise indicated, points are earned on all purchases except gift cards, coupon codes, store credits, delivery charges and carrier charges. 
5. Your store credit are only valid if they are selected and utilised during check-out.
6. We further reserve the right to change, modify (including how points will be earned and redeemed and what rewards will be available). 

T&C: GIFT CARDS

1. We will not be able to amend any details of the Gift Card after the order is placed.
2. Gift Cards purchased are non-refundable or exchangeable.
3. All discount codes which are used cannot be reinstated if orders are cancelled.
4. Gift Cards purchased are not entitled for store credit.

T&C: CURRENCY AND INTERNATIONAL SHIPPING

1. For delivery outside Malaysia, payments will be automatically be converted to shipping country's currency . If the destination currency is not in the default currency , it will be automatically be converted to MYR.
2. Pricing varies across countries and Versuitile reserves the full rights to set this pricing range based on the countries' market conditions, regulatory costs, taxes, tariffs, etc.
3. All purchase has to be made according to the currency/price set by Versuitile website and any special request will not be entertained.
4. Please note the delivery charge does not include any applicable importation charges, taxes and duties by customs in the country where the order is to be delivered. You are responsible for such taxes and duties.
